Abstract | In this article, the author examines the legal positions of the European Court of Human Rights regarding the State protection of the private property rights. At the same time, the emphasis is placed on the problem of the transition from communism to a modern democratic model of relations between private owners and the State. Particular attention deserves the deep analysis made by the author of a large number of decisions of the ECtHR on these issues, including those brought against Ukraine. |
